1. Independent Contractor Status
Driver is an independent contractor, not an employee of FoodRunz or any Vendor.
As an independent contractor, you:
- Control which shift requests you accept or decline
- Provide your own vehicle, equipment, and supplies
- Are solely responsible for your own taxes and self-employment filings
- Are not entitled to employee benefits, minimum wage guarantees, or workers' compensation
FoodRunz does not guarantee minimum earnings or a specific number of assignments.
2. Responsibilities
Driver agrees to:
- Deliver all orders safely, accurately, and in a timely manner
- Follow all routing instructions provided by FoodRunz or the assigned vendor
- Maintain professionalism and courtesy with vendors, customers, and FoodRunz staff
- Protect all customer property and handle orders with care
- Communicate proactively regarding any delays, issues, or emergencies
3. Vehicle & Insurance Requirements
Driver must at all times:
- Maintain a valid, current driver's license in their state of operation
- Carry the minimum required auto insurance coverage
- Maintain their vehicle in a safe, operational, and presentable condition
- Provide proof of insurance and vehicle registration upon request
4. Availability & Schedule
Drivers control their own availability and may accept or decline shift requests at their discretion.
However, once a shift is accepted, drivers must:
- Honor the confirmed shift unless canceled with at least 24 hours notice
- Arrive on time and ready to begin deliveries
- Notify FoodRunz immediately if they must cancel or will be late
Repeated no-shows or last-minute cancellations may result in suspension from the platform.
5. Compensation & Payments (DriverPay™)
Drivers are compensated through FoodRunz DriverPay™ — an automated reconciliation and nightly settlement system. Compensation consists of two components:
- Delivery Fee — $3.99 per completed order: The vendor's POS charges each customer a $3.99 delivery fee. DriverPay™ reconciles this automatically and settles it to you nightly via Stripe Connect. No manual end-of-shift tip-outs.
- Customer Tips — 100% to driver: DriverPay™ AI verifies each customer gratuity against the vendor's POS order data. 100% of verified gratuities are allocated to you and included in your nightly settlement. Nothing is withheld.
- Catering / Event Shifts — Flat Pre-Negotiated Fee: For catering jobs, your compensation is a flat fee agreed upon before the shift and built into the catering order. DriverPay™ settles this fee to you automatically at shift end.
- Performance bonuses or incentives (when applicable) — arranged through the FoodRunz dashboard
DriverPay™ performs nightly settlement via Stripe Connect — directly to your bank account. You must complete Driver Academy™ certification and connect a Stripe account before settlements are released.
If a vendor interferes with POS data or disables the delivery fee, report it immediately via the FoodRunz app or by contacting Driver Support. FoodRunz investigates all reports and may suspend vendors found in violation.
6. Code of Conduct
Driver must not:
- Engage in unsafe, reckless, or negligent driving behavior
- Harass, threaten, or disrespect vendors, customers, or FoodRunz staff
- Tamper with food, packaging, or any customer property
- Misrepresent services, rates, or their relationship with FoodRunz
- Use a phone while driving without a hands-free device
7. Extra Task Requests
Drivers are engaged for delivery services only. If a vendor requests tasks beyond delivery scope (e.g., folding boxes, food prep, cashiering), drivers may:
- Accept only if they agree and additional compensation is arranged through the FoodRunz dashboard
- Decline without penalty — drivers cannot be coerced into extra duties
- Report any pressure or inappropriate requests to the FoodRunz Support Team
8. Termination & Deactivation
FoodRunz may deactivate a driver from the platform for:
- Safety violations or reckless behavior
- Fraud, misrepresentation, or theft
- Repeated or severe poor performance
- Harassment or misconduct toward vendors, customers, or staff
- Failure to comply with background check or documentation requirements
Drivers may voluntarily exit the platform at any time with no penalty, provided all accepted commitments are honored.
